    Hamas Proposes Year-Long Truce with Israel

    Hamas officials in Cairo proposed Sunday a year-long truce with Israel and an opening of the crossings into the Gaza Strip, in the latest round of diplomatic meetings to build on a fragile cease-fire in the Gaza Strip.

    Hamas official Ayman Taha told reporters in Cairo that his delegation was briefed by the Egyptians on an Israeli proposal for a year-and-a-half long truce with only partial opening of the border, which they rejected.

    Instead, Taha says the group made a counter offer of a year with open borders, which they now must discuss with their leadership in Damascus.

    Palestinian President Mahmoud Abbas has criticized the Hamas leadership for bringing destruction to Gaza.
    At a press conference Tuesday, Abbas blamed Hamas for violating a six-month cease-fire with Israel. He said they provoked the massive Israeli response that killed nearly 1,300 people in Gaza, including hundreds of civilians.
    Abbas said Hamas leader Khaled Mashaal could be taken to court in another country for "drawing his people to this destruction." He said he had warned Hamas against violating the truce "but they didn't listen."

    International Law and the Gaza Conflict, Redux: One thing that's clear from the recent Gaza conflict is that to many leftists, "violations of international law" is simply shorthand for "a country is engaging in military action that I don't approve of."
    A case in point is a statement, via Brian Leiter, by self-styled "American Jewish progressives" (some of whom, I note, seem to assert their Jewish identity only when its useful for bashing Israel) on Gaza. The statement claims that Israel acted "with little or no consideration for human rights or the laws of war."
    As usual with such statements, not a single documented violation of the laws of war is mentioned. Say what you will about the wisdom, or even morality, about the IDF's actions in Gaza, the idea that it acts "with little or no consideration for the law of war" is absurd. Not only does the IDF have strict internal rules promulgated by its version of the JAG, but it knows it has the entire international left breathing over its shoulder, looking for any violations of rules that could be exploited for propaganda purposes.
    We could review for many paragraphs the various actions Israel took to limit civilian casualties, such as calling people living in Hamas weapons depots (also serving as apartment buildings) to warn them that a bombing raid was imminent, even though this also allowed the "bad guys" time to escape. And I can once again refer to the retired British army colonel who remarked that there has bee "no time in the history of warfare when an army has made more efforts to reduce civilian casualties and the deaths of innocent people than the IDF."
    But the argument against such broad indictments of Israel is even simpler. Even Israel's harshest critics claim no more than 1,400 or so deaths in Gaza, with a significant fraction of those Hamas fighters. If Israel truly "little or no consideration for human rights or the laws of war," why were the casualty figures that low? Surely Israel could have unleashed far greater devastation, while also achieving more of its military objectives. Israel could have, for example, demolished Shifra Hospital, which has underground bunkers that served as a command center for the Hamas leadership. That leadership survived the war because Israel wouldn't demolish a working hospital to get at them.
    In any event, I'll lay down the challenge to the signators of the statement that one should issue whenever one sees similarly ignorant statements: Precisely what "laws of war" do you claim Israel violated in Gaza, what is your evidence for these violations, what treaties or legal precedents can you cite to support your claim, are you aware of legal authorities that disagree with your interpretation of international law, and under what legal theory is Israel bound by whatever particular international law principle that you are purporting to apply (e.g., if you are citing a treaty that Israel specifically declined to be a party to)? Comments are open below for the signators. [UPDATE: One more: Specifically, what could Israel have done differently in Gaza that would lead you to acknowledge that it had complied with the laws of war. If the answer is, as I suspect for many signators it would be, "not go into Gaza to begin with," then obviously we can go back to the first sentence of this post."]
    Near as I can tell, only one law professor signed this statement, but surely he wouldn't have signed it without having answers to those questions readily at hand, so perhaps he can enlighten us. And note, while it's possible (though not yet proven) that there were isolated violations of international law by a unit here or there, such as the controversy over the alleged failure to allow Red Crescent ambulances to reach a certain neighborhood for several days, proof of isolated violations of international law, contrary to army policy, would still not support the claim that there was "little or no consideration," overall, of the laws of war.

    Israel delays aid trucks from Egypt to Gaza

    EL AUJA BORDER CROSSING, Egypt: France sent technical equipment to help Gazans draw water from the ground. The Swiss sent blankets and plastic tarps. Mercy Corps, a relief agency, sent 12 truckloads of food. And on Wednesday all of it, including dozens of other trucks carrying sugar, rice, flour, juice and baby formula, sat in the hot sun here going nowhere.

    This normally quiet commercial crossing between Egypt and Israel has been turned into a parking lot of stalled humanitarian aid, and in the city of El Arish there are even greater quantities of food, clothing and essential supplies, sitting, waiting and baking in the sun. Some supplies are loaded onto dozens of trucks parked on city streets, but much more is stored in the open areas of a local sports stadium, also waiting, also going nowhere. Only medical supplies seem to be getting through to Gaza.

    GAZA: A Palestinian explosive killed an Israeli soldier just outside Gaza on Tuesday and Israel retaliated with an incursion that killed a Palestinian in the first serious confrontations between Hamas and Israel since each declared a tentative cease-fire 10 days ago.

    With the new U.S. envoy to the region, George Mitchell, arriving in Jerusalem on Wednesday, the fighting here underlined the urgency of his mission.

    Hamas seemed eager to play down what had happened, saying it was not clear who had planted the device inside Israel apparently under cover of fog in the early morning, setting it off by remote control. But Israeli officials saw the attack, which also wounded three, as an ominous sign of Hamas testing it following the recent three-week war.

    Turkish PM storms off in Gaza row

    Turkey's prime minister has stormed off the stage at the World Economic Forum in Davos after a heated debate on Gaza with Israel's president.

    Recep Tayyip Erdogan clashed with Shimon Peres, whose voice had risen as he made an impassioned defence of Israel's actions, jabbing his finger.

    Mr Erdogan said Mr Peres had spoken so loudly to conceal his "guilt".

    He accused the moderator of not allowing him to speak and said he did not think he would return to Davos.

    Israeli PM vows 'sharp response' if Gaza attacks continue

    JERUSALEM (CNN) -- Israeli Prime Minister Ehud Olmert on Sunday promised a "sharp Israeli response" if rocket attacks from Gaza continue. Palestinian militants fired four rockets into southern Israel on Sunday, police said.

    Israel was holding to its position that "if firing continues against residents of the south, there would be a sharp Israeli response that would be disproportionate," Olmert vowed at the beginning of the weekly Cabinet meeting. "We will not go back to the rules of the game that the terrorist organizations tried to dictate in the past. ... We will act according to new rules that will ensure that we are not dragged into an unending shooting war on the southern border."

    One of the mortars landed near a kindergarten in the western Negev, but there were no injuries in that attack or the others, police said.

    The attacks were another breach in a tentative cease-fire which Israel and Hamas militants each declared unilaterally after a three-week Israeli military operation in Gaza which has left the territory still tense.

    Israel launched the attack on Hamas in Gaza on December 27 with the stated aim of ending rocket attacks on southern Israel.

    More than 1,300 Palestinians died and about 5,400 others were wounded. Thirteen Israelis, including 10 soldiers, were also killed in the fighting.

    On January 21, Israel and Gaza's Hamas leadership each declared a temporary cease-fire which took effect after Israeli forces withdrew from the Palestinian territory.

    Since the cease-fire began, militants have sporadically fired rockets into Israel. Israel has responded with air strikes.

    Another security official, also speaking on condition of anonymity, said $9 million and 2 million euros were found. The discrepancy could not be immediately explained.
